These Peer-to-Peer Contractor Terms & Conditions ("Terms") govern the relationship between independent contractors ("Contractors") and Clients utilizing Jobbi's platform for peer-to-peer engagements. These Terms are supplementary to and should be read in conjunction with Jobbi's general Terms and Conditions ("Terms"), which are incorporated herein by reference.
2.1 It is expressly understood and agreed that the relationship between the Client and the Contractor is a direct, peer-to-peer relationship. Jobbi's role is limited to providing a platform to facilitate the connection and payment management between Clients and Contractors.
2.2 Contractors are independent contractors and are not employees of Jobbi. Nothing in these Terms shall be construed to create an employment relationship, partnership, or joint venture between Jobbi and the Contractor.
2.3 The Client has direct control over the project scope, including deliverables, timelines, and the manner and method by which the Services are performed.
3.1 Contractors must create and maintain accurate profile on Jobbi's platform, including relevant information about their skills, experience, and qualifications.
3.2 Contractors are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
3.3 Contractors must adhere to professional standards when interacting with Clients and responding to project inquiries.
3.4 Contractors must not bypass Jobbi's payment system or attempt to conduct transactions with Clients outside of the platform unless explicitly permitted.
3.5 Contractors agree to comply with all applicable laws and regulations related to the services they provide, including but not limited to tax obligations and business licensing requirements.
4.1 Contractors and Clients are responsible for negotiating and agreeing on the terms of service for each project or engagement. Jobbi may provide templates or tools to facilitate this process, but the final agreement is between the Contractor and the Client.
4.2 Service agreements should include clear project scope, deliverables, timelines, payment terms, and any other relevant project-specific terms.
4.3 Clients are responsible for providing clear and accurate project requirements and for timely payment to Contractors in accordance with the agreed-upon terms.
5.1 Jobbi facilitates payments between Clients and Contractors. Contractors must provide accurate payment information to Jobbi to receive payments.
5.2 Jobbi does not deduct platform fees from Contractor earnings unless a premium service is used or an optional transaction fee applies.
5.3 Contractors are responsible for understanding and complying with tax obligations, social security contributions, and income reporting in their respective jurisdictions.
5.4 In the event of payment disputes, Contractors must contact Jobbi's support team for mediation. Jobbi may freeze disputed funds until resolution.
6.1 Unless otherwise specified in a service agreement, all work product resulting from the services performed by the Contractor for the Client, unless otherwise agreed in writing between the Contractor and Client.
7.1 Contractors may have access to confidential information of the Client. Contractors must protect such confidential information and not use it for any purpose other than performing the services.
8.1 Jobbi is not a party to contracts between Clients and Contractors and is not liable for any disputes, claims, or damages arising out of those relationships.
8.2 Jobbi is not responsible for employment outcomes, and all contractual obligations remain between the Contractor and the Client.
9.1 Either the Client or Contractor may terminate a service agreement in accordance with the terms agreed upon between them.
9.2 Jobbi reserves the right to suspend or terminate a Contractor's access to the platform for violations of these Terms or Jobbi's general Terms and Conditions.
10.1 Any disputes arising out of or relating to this Contract shall be resolved in accordance with the dispute resolution provisions in the Terms.
11.1 This Contract shall be governed by and construed in accordance with the laws of Jobbi's HQ location country, outlined in the Terms, unless otherwise required by mandatory applicable law.
12.1 Jobbi reserves the right to amend this Contract at any time.
13.1 This Terms, together with Jobbi's Terms and Privacy Policy, constitutes the entire agreement between the parties relating to the Peer-to-Peer Contractors Services.
13.2 In the event of any conflict or inconsistency between these Peer-to-Peer Contractors Terms & Conditions and Jobbi's general Terms and Conditions regarding the provision of Services, however, any of such separate agreements exist, these Peer-to-Peer Contractors Terms & Conditions, along with Jobbi's general Terms and Conditions, shall govern.
13.3 In the event of any conflict or inconsistency between these Peer-to-Peer Contractors Terms & Conditions and any separate agreement between a Contractor and a Client, these Peer-to-Peer Contractors Terms & Conditions and Jobbi's general Terms and Conditions shall prevail to the extent of the inconsistency or conflict.
By using Jobbi's Outsourcing Services, the Client acknowledges that it has read, understood, and agrees to be bound by this Outsourcing Model Service Terms and Conditions and Jobbi's Terms and Conditions. Continued use of Jobbi constitutes ongoing acceptance of any future updates or modifications to these terms. If users do not agree with any part of these Terms & Conditions, they must discontinue use of the platform immediately.
